Herndon-Reston Indivisible members, Senate Majority Leader Mitch McConnell has promised a final floor vote on popular vote loser Donald Trump’s right-wing Supreme Court nominee, Neil Gorsuch, this week.
Republicans, who have a 52-48 majority, need a total of eight Democrats to end a filibuster and confirm Gorsuch. Three Democrats—Sens. Manchin (WV), Heitkamp (ND), and Donnelly (IN)—have already committed to voting with Republicans to end the filibuster, leaving Republicans only five votes short of placing Gorsuch on the highest court.
Senator Mark R. Warner has not committed to supporting a filibuster of Gorsuch’s confirmation. Trump and right-wing extremists control two-thirds of the federal government. The judiciary is our last and only line of defense against their hateful and dangerous agenda. Kay, since you are their constituent, we need your help to defend the Supreme Court.

On Sunday, red state Democratic Senator Jon Tester issued the following statement after announcing that he will vote against Gorsuch’s confirmation:
“With Judge Gorsuch on the bench, I am deeply concerned that dark money will continue to drown out the voices and votes of citizens, the Court will stand between women and their doctors, and the government will reach into the private lives of law-abiding Americans.”
In addition to Sen. Tester concerns, Gorsuch has a terrible record of supporting corporations and employers over workers and labor rights. A lifetime appointment for him would tilt the court even more to corporations and employers—hurting labor rights, workers, and everyday people for generations.
Judge Gorsuch cannot meet the 60-vote threshold to become a Supreme Court justice without Democrats. And Democrats cannot support his nomination lest they legitimize Trump’s hateful policies, undo decades of civil rights progress and destroy the foundations of our democracy for generations.
We need to make sure Democratic senators hear us loud and clear: Join the filibuster and refuse to collaborate with extremist Senate Republicans to put Gorsuch on the bench.
